i <br /> (5) Any person who is a party to an existing contract with such public servant ... <br /> and who by reason thereof is in a position to affect directly the economic interests <br /> of such public servant. <br /> 1 . , <br /> La. R.S. 42:1112(D)-., <br /> No appointed member of any board or commission, except as otherwise provided <br /> in R.S. 42:1120.4, shall participate or be interested in any transaction involving the <br /> agency when a violation of this part would.result* <br /> 1.4. <br /> La. R.S. 4 :1120.4 provides an exception for appointed members of a. hoard or <br /> commission to recuse themselves firorn voting on matters that violate R.S. 42:1112, provided the <br /> appointed members do not participate in the discussion and debate of the nutter, <br /> 1 . <br /> La. R.S. 42 t .1 0 provides the following relevant definitions when analyzing the above <br /> Sections: <br /> (2) "Agency's means a department, office, division, agency, commission, board, <br /> cOMMIttee, or other organizational unit of a governmental entity. <br /> (12) "Governmental entity" means the state or any political subdivision which <br /> employs the public employee or employed the former public employee or to which <br /> the elected official is elected, as the case may be. <br /> (15) "Participate" means to take part in or to have or share responsibility for action <br /> of a govermuental entity or a proceeding, personally, as a public servant of the <br /> governmental entity, through approval, disapproval, decision., recommendation, <br /> the rendering of advice, investigation, or the failure to act or perform a duty. <br /> (16) "person"means an individual or legal entity other than a governmental entity, <br /> or an agency thereof. <br /> (18) "public employee" means anyone, whether compensated or not, who is: (i) <br /> An adrnini strativc officer or official of a governmental entity who is not filling an <br /> elective office; (ii) Appointedby any elected official when acting in an official <br /> capacity, and the appointment is to a post or position wherein the appointee is to <br /> serve the govermnental entity or an agency thereof, tither as a member of an <br /> agency, or as an employee thereof'.; (iii) Engaged in the performance of a <br /> Page 4 of 6 (Docket No. 2024-119) <br />
