IIVO <br /> PROVISIONS OF LAW <br /> 1. <br /> La. R.S. 4 :1111 (1)(a) provides that no public sant shall receive any thing of economic <br /> value for any service, the subject matter of which is devoted substantially to the responsibilities, <br /> prograins,, or operations of the agency of the public servant and in which the public servant has <br /> p ati cip ated. <br /> 2. <br /> Lia.R.S.42*1102 provides the following definitions: <br /> (2)(a) "Agency"� mea-ns a department,office,oA division, agency, commission,board, committee, or <br /> other organizational unit of a govemmental. entity. <br /> (15) "Participate" means to take part in or to have or share responsibility for action of a <br /> govermmental entity or a proceeding,personally,as a public servant of the governmental entity, <br /> through approval,disapproval., decision,recommendation, thQ irundodrig of advice,investigation., <br /> or the failure to act or perform a duty. <br /> (16) "Pearson" means an individual or legal entity other than a governmental entity, or an agency <br /> thereof. <br /> (18)(a) "Public employee'means anyone, whether compensated or not,who is, <br /> (i) An administrative officer or official of a governmental entity who is net filling an <br /> elective O f . <br /> (ii) Appointed by any elected official when acting in an official capacity, and the <br /> appointrrnent 'is to a post or position wherein the appointee is to serve the governmeDtal <br /> entity or an agency thereof, either as a member of an agency,or as an mployee thereof: <br /> Page 4 of <br />
