Endom, Jr. <br /> Hammonds & Sills <br /> Quad One, Suite C <br /> 1111 South Foster Drive <br /> Baton Rouge, Louisiana 70806 <br /> Re: Ethics Board Docket No. 2010-1112 <br /> Dear Mr. Endom: <br /> The Louisiana Board of Ethics, at its December 17, 2010 meeting, considered your request <br /> for an advisory opinion as to whether Rebecca Hebert may accept employment as a certified <br /> teacher with Lusher Charter School while her mother, Kathleen Riedlinger, serves as the <br /> Chief Executive Officer of the Lusher Charter School. You stated that Lusher Charter <br /> School is operated by the Board of Directors of the Advocates for Arts-Based Education <br /> 0 Corporation. Lusher Charter School is a kindergarten through 12 th grade charter school <br /> operated on two campuses and three separate grade components; lower, middle and high <br /> school. Each grade component has its own principal who reports to the corporation's chief <br /> Executive Officer, Kathleen Riedlinger. <br /> The Board concluded,without the participation of Board Member Schneider, and instructed <br /> me to inform you,that the Code of Governmental Ethics would not prohibit the employment <br /> of Rebecca Hebert as a certified teacher with Lusher Charter School while her mother, <br /> Kathleen Riedlinger, serves as the Chief Executive Officer of the Lusher Charter School. <br /> Section 1119B of the Code prohibits the immediate family member of the chief executive of <br /> a governmental entity from being employed by the governmental entity. Section <br /> 1119B(2)(a)(I)of the Code provides an exception to permit the employment of an immediate <br /> family member of a school board member or the superintendent if the person is employed as <br /> a certified classroom teacher. In this instance, the Board advises that the chief executive <br /> officer of a charter school is like the superintendent of a parish school board. <br /> In addition,the Board concluded,and instructed me to inform you, that Section 1112B(1) of <br /> the Code would prohibit Kathleen Riedlinger participation in the supervision and <br /> management of her daughter's employment with Lusher Charter School. Section 1112B(1) <br /> of the Code prohibits a public servant from participating in a transaction involving his <br /> governmental entity in which a member of his immediate family has a substantial economic <br /> interest. <br /> • <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
