Box 1004 <br /> Lake Charles, Louisiana 70602 <br /> Re: Docket No. 2023-068 <br /> Advisory Opinion <br /> Dear Ms. Williams: <br /> The Louisiana Board of Ethics, at its April 5, 2023 meeting, considered your advisory opinion <br /> request as to the applicability of the Code of Governmental Ethics ("Code") with respect to your <br /> appointment as a hearing adjudication officer. <br /> FACTS PROVIDED <br /> You were recently appointed as a Hearing Adjudication Officer for the City of Lake Charles. This <br /> is an unpaid position. You are also interested in running for district court judge in an upcoming <br /> election. You also serve as the President for Girlie Girls Mentoring Program, Inc., a Louisiana <br /> non-profit corporation("GGMP"). This is also an unpaid position. <br /> You would like to know whether you are permitted to run for district court judge and serve as an <br /> officer of GGMP while holding your current position as Hearing Adjudication Officer. <br /> LAW <br /> La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction involving the <br /> governmental entity in which, to his actual knowledge, any person of which he is an officer, <br /> director,trustee, partner, or employee has a substantial economic interest. <br /> La. R.S. 42:1102(15) defines "participate" to mean to take part in or to have responsibility for <br /> action of a governmental entity or proceeding,personally, as a public servant of the governmental <br /> entity, through approval, disapproval, decision, recommendation, the rendering of advice, <br /> investigation, or the failure to act or perform a duty. <br /> La. R.S. 42:1102(18)(a) defines"public employee"to mean any person,whether compensated or <br /> not who is: (i) an administrative officer or official of a governmental entity who is not filling an <br /> elective office; (ii) appointed by any elected official when acting in an official capacity, and the <br /> appointment is to a post or position wherein the appointee is to.serve the governmental entity or <br /> Page 1 of 3 (BD 2023-068) <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
