R.S. 42:1112B(2) by participating in the lease of office speace by the Coroner's Office from Jet Cash, LLC, a company owned by his business partner, Mass Prentiss Blackwell, Jr. and by submitting two invoices totaling $9,635 to the Coroner's Office from Three Deuces, Inc., for construction work performed on the new Coroner's Office by Three Deuces, Inc., a company owned by Mass Prentiss Blackwell, Jr.

Advisory opinion that the daughter of a captain within the Leesville Fire Department would not be prohibited by the Louisiana Code of Governmental Ethics from being employed as a firefighter with the Leesville Fire Department since her father does not appear to be an agency considering the Fire Chief of Leesville Fire Department has the sole authority to hire, fire, and prepare work schedules of the Department. However, the father would be prohibited from participating in any matters involving the Department in which his daughter would have a substantial economic interest.

Advisory opinion that daughter of the Chief Deputy of the Jefferson Davis Sheriff’s Office would not be prohibited by the Louisiana Code of Governmental Ethics from being employed within the Criminal Investigations Division of the Sheriff’s Office since the Chief Deputy is not considered an agency head of the Division. However, a disqualification plan would need to be submitted for approval by the Board and in compliance with La. R.S. 42:1112C and Chapter 14 of the Boards Rules.

Advisory opinion that each public servant bears the responsibility of completing annual mandatory ethics trainings per La. R.S. 42:1170(3)(a)(i) of Louisiana Code of Governmental Ethics. However, each state agency is required to provide instruction and information to the public servants on which ethics laws they are subject to including the completion of the one hour mandatory ethics training. The responsibility for failure to provide such information or instruction to the agency’s employees as required by La. R.S. 42:1170C(1) would fall upon the person so designated by each state agency.

Advisory opinion that the Louisiana Code of Governmental Ethics requires the appointed board members and their designees of the Shreveport/Caddo Metropolitan Planning Commission to file personal financial disclosure statements pursuant to La. R.S. 42:1124.2.1, since the Shreveport/Caddo Metropolitan Commission has the authority to make binding recommendations to the City or Parish Council on the expenditure, disbursement, or investment of $50,000 or more in funds in a fiscal year.

Advisory opinion that the Louisiana Code of Governmental Ethics would not prohibit the former Deputy Chief over Strategic Planning in the Planning and Research Division of the Louisiana Coastal Protection and Restoration Authority (CPRA) from seeking employment with Abt Associates since Abt Associates does not currently have any contracts with CPRA that the employee participated in while employed by CPRA and the employee was not considered an agency. Further, Abt Associates would not be prohibited from seeking future contracts with CPRA provided that the former employee has not participated on those projects during his employment with CPRA.

R.S. 42:1121.
