RE:
Advisory opinion request from Mehdi Nilforoushan regarding whether he may work with consultants on state projects on a contractual basis after his retirement from the Department of Transportation and Development.
Facts:
Mehdi Nilforoushan worked in the Hydraulics section of DOTD for 27 years until his retirement on June 22, 2012. His job duties included reviewing hydrology and hydraulics portions of construction plans of road and highway projects, reviewing off-system bridge replacement project hydrology and hydraulics reports, and performing hydrology and hydraulics studies for on-system bridges over waterways. Mr. Nilforoushan would like to work as a contractor performing hydrology and hydraulics work on projects with consultants that contract with DOTD. These activities would not include projects that he participated in while employed with DOTD and would not be the same service that he performed while employed with DOTD.
Law:
Section 1121B(1) of the Code of Ethics states that no former public employee shall, for a period of two years following the termination of his public employment assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he is formerly employed.

Section 1121B(1) also states that a former public employee, for a period of two years following the termination of his public employment may not render any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the proposed advisory opinion.
