Appearance in connection with a request that the Board waive the $400 and $400 campaign finance late fees assessed against Michael A. Ragusa, a candidate for Mayor of Independence, in the March 24, 2012 election, whose EDE-P and EDE-G campaign finance disclosure reports were filed 294 and 279 days late.
Facts:
In connection with his request for a waiver of the $400 and $400 late fees assessed for the late filings of an EDE-P and EDE-G campaign finance reports, Michael A. Ragusa, states that he would like to address the Board regarding the late filings of his reports.

Mr. Ragusa is an any other level candidate. This is his second campaign. He was a successful candidate.

As an any other level candidate, Mr. Ragusa became required to file reports on January 18, 2012, when he received a $1,000 contribution. Mr. Ragusa was sent a notice of delinquency for the EDE-P report on April 5, 2012 and the notice was received on April 9, 2012 (see attached documentation). A notice of delinquency for the EDE-G report was not sent, however, Mr. Ragusa was sent a reminder notice for the EDE-G report (see attached). Mr. Ragusa was eventually referred for failure to file the reports. It was after contact by a staff investigator, when the reports were finally filed.

An EDE-P campaign finance report filed 6 days late, in connection with the February 9, 2008 election, and 30-P, 10-P, and 40-G campaign finance reports filed 4, 12, and 11 days late, in connection with the March 12, 2012 election. The late fees assessed for the late filings of the reports have been paid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b) Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
