RE:
Request that the Board waive a $40 and $120 late fee that was assessed against Mary Morris, a candidate for Lake Charles Constable in the April 6, 2013 election whose 10-P report was filed 1 day late and an EDE-P report that was filed 3 days late.
Facts:
In connection with her request that the Board waive a $40 and $120 late fee for the late filing of the 10-P and EDE-P reports, Ms. Morris states that she did not file an EDE-P report because although she had radio ads for the election day, she paid for the ads prior to the actual election day. She states that once Cheryl Vermaelen explained to her that expenditures whether paid for on the day of the election or not but used on election day are to be reported on the EDE-P report, she immediately faxed in the report. She states that the same expenditures were reported on her 10-G report.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
