RE:
Request that the Board waive a $500 late fee that was assessed against Janet Ahern, a candidate for Orleans Parish Civil Court Judge in the March 24, 2012 election whose Supplemental report was filed 5 days late.
Facts:
In connection with her request that the Board waive the $500 late fee, Ms. Ahern states that she was aware that a report was due in February, however, she was not clear about the date that the report was due. She thought that the report was due either on February 15 or February 28. Ms. Ahern states that she never received notice from the Board regarding the filing of the Supplemental report. Ms. Ahern states that she reviewed the Board's website and the Secretary of State website and could not determine when the report was due. Ms. Ahern states that she contacted the Board's staff for guidance and was informed that the Supplemental report was due. She states that she was informed that notice for filing the report was sent to her office address. Ms. Ahern states that she has not used the address given since 2006 and that her reports filed in connection with the 2012 election contained her home address. This is the candidate' second election.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $300 based on future compliance.
