Request that the Board waive a $240 late fee that was assessed against Jefferson Joyce, a candidate for Ouachita Parish City Court Judge in the October 2, 2010 election, whose Supplemental report was filed 4 days late. |

In connection with his request for the waiver, Judge Joyce states that he disagrees with four day assessment. He states that although the report was due on February 15, 2013, the 16th and 17th were on the weekend and should not be counted in the assessment. He also argues that the 18th was a state and federal holiday (President's Day) and all offices were closed. Thus, he should only be assessed for the one day, February 19, 2013, the day he filed the report. He also argues that he has been wrongfully assessed as a district office candidate. He states that his district only covers half of the City of Monroe and the population of the District is less than 35,000. As such he believes that he should have been assessed as an "any other" level candidate. Finally, Judge Joyce states that he would like the entire fine waived due to the absence of his legal assistant being in the office on February 15. He states that it was her responsibility to file his reports and that she was more familiar with the filing process.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
