Advisory opinion regarding whether a biologist for the Department of Wildlife and Fisheries, Martin Floyd, may provide services to companies outside of the Department of Wildlife and Fisheries.
Facts:
Martin Floyd is currently employed with the Department of Wildlife and Fisheries as a Biologist III. As a biologist, Mr. Floyd is responsible for assisting with the Natural Resource Damage Assessment (NRDA) and oil spill response activities associated with the Mississippi Canyon 252 incident. He assists the NRDA teams with field data collection and research, NRDA protect planning, restoration planning, and oil spill response as needed.



Ensave, a company headquartered in Vermont, needs ground assistance to evaluate farms (poultry and possibly crawfish) to inventory machinery for an energy efficiency evaluation for a new USDA -NRCS program. In this capacity, Mr Floyd would make on-farm inventory of their existing equipment and send it to their headquarters in Vermont. The other evaluation is connected to his private company, Floyd ECOonsultants LLC. He has not performed any work under his private company but would like to know where a conflict may exist if work is completed through his private company. Ensave does not have any current contracts with the Deparment of Wildlife and Fisheries.

Law:
Section 1113 of the Code prohibits a public servant from entering into transactions that are under the supervision of the agency of the public servant. Section 1111C(2)(d) of the Code prohibits a public servant from accepting compensation from a person who has a contractual, business or financial relationship with the agency of the public servant, who conducts activities or operations that are regulated by his agency or who has an economic interest that Mr. Floyd can affect by the performance of his duties a public servant.
Recommendations:
Adopt the proposed advisory opinion.
