Advisory opinion request from Ms. Donna Mathews seeking clearance to work as a Volunteer Coordinator with the Rapides Children's Advocacy Center/CASA following her employment with the Department of Children and Family Services (DCFS).
Facts:
Ms. Mathews is an employee of the Alexandria Region of the DCFS, and plans to retire at the end of July. While employed with DCFS, she served in a number of positions. The most recent being as the Community Specialist/Program Coordinator - a position she served in for eleven years. In that position she was required to have basic, general knowledge of the programs under the Child Welfare Section for the purpose of outreach and information to the public and other agencies. At no time during her thirty-three years of employment with CFS has she ever performed any tasks or job duties within the Child Welfare Section which provides direct services to the children and families under their supervision or has she supervised any of the persons providing direct care to those families.

The only position in which Ms. Mathews did serve as a supervisor at DCFS was thirteen years ago when she worked in the Child Care Assistance Division. As head of that department she supervised three to four employees in maintaining the federal program that assisted clients of the agency to pay for portions of their child care during work or while attending classes. Child Care Assistance had no connection to the Child Welfare Program.

In Ms. Mathews' position with the Rapides Children's Advocacy Center/CASA she will supervise and coordinate volunteers. CASA is a nonprofit agency that advocates for abused and neglected children who are under the Child Welfare Section of the DCFS. Ms. Mathews will not work on any matters with CASA that she participated in with DCFS. Further, since she did not work in the Child Welfare Section of DCFS then she does not anticipate having any clients with CASA whom she served while an employee of DCFS.

Law:
Section 1121B of the Code prohibits a former public servant for a period of two years from the termination of their public employment from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, in which she participated at any time during her employment and involving the agency in which she was employed.

Recommendations:
Adopt proposed advisory opinion.
