Advisory opinion request from Washington Paris Sheriff Randy "Country" Seal regarding whether newly elected Assessor Mr. James A. Stevenson, Jr., may continue to appraise property for the Sheriffs Office.
Facts:
Washington Parish Sheriff Randy "Country" Seal has requested an advisory opinion about whether newly elected Assessor, Mr. James A. Stevenson, Jr., may continue to appraise property for the Sheriffs Office.
Sheriff Seal has stated that Mr. Stevenson is one of only four state certified appraisers that his office uses to appraise property. Mr. Stevenson would receive a fee for his service in the amount of $200.00. This fee is not paid by the Sheriff's general fund. Each charge for services is applied to the case and billed to the foreclosing attorney once the attorney's office pays all of the fees including, sheriff's costs, commission, advertising fees, appraisal, clerks cost, and storage fees. The disbursements are issued out of the fund for the sales called the Sheriff's Fund to each individual vendor.

Law:
La. R.S. 42:1111A No public servant shall receive any thing of economic value, other than his compensation and benefits from the Governmental entity to which he is entitled , for the performance of the responsibilities of his office or position.


LA. R.S. 42:1111C(1)(a)No public servant shall receive any thing of economic value for any service the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participate.


Recommendations:
Adopt draft advisory opinion.
