RE:
Waiver request submitted by Marie Adams, member of the Kingswood Subdivision Improvement District, regarding a $1,500 late fee assessed for filing her 2010 Tier 2.1 annual pfd 258 days late.
Facts:
Ms. Adams states that mid 2009 through 2012 were very turbulent times for her and her family. In July 2010, her step-father was interdicted and she became his Curator. she was responsible for taking care of all of his and her mother's daily bills, household duties and health needs. In 2010, the Court ordered her to remodel her step-father's and mother's home. Due to bad legal advice, she maxed out her credit cards paying for this remodel. Since that time, the Court has ordered that she be reimbursed.

In February 2011, her sister unexpectantly died. Subsequently, her mother fell and broke her hip requiring two emergency surgeries and rehab. She had to find emergency housing for her step-father as her mother was his primary caregiver. The recovery periods were long.

The assessment will still cause a financial hardship.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Based on the waiver guidelines, waive the late fee.
