Waiver request submitted by Wendy O'Quinn-Perrette, a member of the Bogalusa City Council, regarding a $2,500 late fee assessed for filing her 2010 Tier 2 annual pfd 309 days late.
Facts:
Ms. O'quinn-Perrette states that he husband passed away on 4/3/2010 and ten days later her father-in-law passed away on 4/13/2010. Ms. O'quinn-Perrette's step-grandfather passed away in February 2011. She was the sole caretaker of all three family members. Following their deaths, Ms. O'quinn-Perrette had her hands full with her 5 year old son who was grieving the loss of these important men in his life as well as hers. In April 2010, her husband's identity was stolen by a man in Tampa, FL. She was unable to file her 2010 tax returns until January 2013, which has also held up settling the estates. Ms. O'Quinn-Perrette states she could not think straight during these times.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Based on the waiver guidelines, waive the late fee.
