RE:
Request the Board waive the $2,000 campaign finance late fee assessed against Walter A. "Walt" Bennetti, a candidate for Council Member Jefferson Parish, District 4, in the October 22, 2011 election, whose 10-G campaign finance disclosure report was filed 463 days late.
Facts:
In connection with his request that the Board waive the late fees assessed for the late filing of the report, Walter Bennetti states that he submitted a report to the Board of Ethics on November 10, 2011, which he believed to be the report that was due 10 days prior to the November general election even though he was not participating in the general election. He states that for whatever reason, the computer transmitted his election day report instead of his 10-G report. When he received the email receipt he did not realize that the improper report was transmitted. He further states that when he was contacted by the Board of Ethics regarding the matter, he mailed copies of the email receipt on several occasion and at no time was he told that the report transmitted on November 10, 2011 was not the proper report. When he opened his computer program to enter and transmit his annual report due February 15, 2013 the computer also transmitted his 10-G report. He says that there is a glitch in the computer program or within his computer.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
