Appearance in connection with a request that the Board waive the $600, $2,000, $600 and $600 campaign finance late fees assessed against Micah Hebert, a candidate for State Representative, 54th District in the October 22, 2011 election, whose 30-P, 10-P, EDE-P and 10-G campaign finance disclosure reports were filed 662, 642, 622, and 614 days late.
Facts:
In connection with the request that the Board waive the assessed late fees, John Sinnott, states that Mr. Hebert was deployed out of the country on active duty with the Marine Corp during the majority of the pre-election period. Mr. Hebert asked his sister to file the appropriate qualifying documents for him by proxy. He returned shortly before the election. Mr. Hebert is a young man who ran as an independent. He had minimal expenses and was entirely self-funded. Mr. Hebert is enrolled at Loyola and was unaware of the applicable disclosure requirements and did not understand that the requirements applied to a minimal self-financed candidate. He did not have a campaign manager or staff. There was also delay caused by the Board sending notices and charges to Hebert at an old address where Hebert no longer resides.

Mr. Hebert served two tours in combat with the Marines. He is a decorated combat veteran having earned the prestigious Navy and Marine Corps Commendation Medal with Combat Valor recognition. He struggles with Post Traumatic Stress Disorder. Mr. Hebert has no savings and his sole source of money is a small monthly stipend from the G.I. Bill.

Mr. Sinnottt has attached a letter written by Mr. Hebert which reflects the same ideas that are stated by Mr.Sinnott.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
Recommendations:
Without documentation to support the deployment and financial need, suspend all but $200 for the 10-P report and decline to waive the fees for the 30-P, EDE-P, and 10-G.
