RE:
Request that the Board waive the $2,500 campaign finance late fee assessed against Jeffery Oglesbee, a candidate for Family Court Judge, 21st JDC, in the October 19, 2013 election, whose 180-P campaign finance disclosure report was filed 39 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Jeff Oglesbee states that on or about March 22, 2013, the "Jeff Oglesbee Campaign Committee" was formed with the purpose of seeking a judicial seat on the 21st JDC. Upon forming the committee, he was given very little paperwork regarding the office, particularly any paperwork about the campaign finance requirements of his particular office. Prior to forming the committee he contracted with Lee Gray and Associates, a CPA located in Amite, LA to handle his campaign finances.

At the time of forming the committee, he was advised by his CPA that the office which he was seeking was a district level office. The reporting requirements and the contributions requirements were explained to him based upon the knowledge that the judicial seat he was seeking was a district level office. On or about May 28, 2013, he was informed that the 21st JDC Judges had been made a major office for the purpose of campaign finance requirements. Immediately upon being notified that the office had been changed to a major office, he contacted his CPA and requested that she determine if this was correct and when did he need to file a report.

Upon being notified by her that it was in fact a major office, he requested that she immediately file the report with the Board of Ethics which she did on May 31, 2013. He states that there was no intent on his part to withhold or delay reporting of any campaign finance information. He further states that none of his contributions exceeded $2500 an indication that he was under the impression that it was a district level office. He states that he does take responsibility for the late reporting and would request the Board to take into account the unique situation presented in the 21st JDC with the change from a "district level office" to a "major office".

He requests that the board consider a reduction of his late fee to $500 which he believes this amount is more in line with the erroneous information that was provided to him with the historical reporting requirements previously required by the office for which he is seeking.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Waive the late fee.
