RE:
Request that the Board waive the $400 campaign finance late fee assessed against Larry Hanisee, a candidate for Councilman, District 5, Town of Bossier, in the May 4, 2013 election, whose EDE-G campaign finance disclosure report was filed 10 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Larry Hanisee states that he personally completed all of the submissions to the Board and he was unaware of the EDE-G late filing until he completed the report in April. As soon as he realized his mistake he completed the filing and called our office. He was advised to go ahead and submit the proper paper work, which he did. He states that he had very few donations and the only one he had was for $500.

He states that it did not impact the election and he lost. He says he is not considering running for office again and has written off thousands of dollars he personally spent on the campaign. He further states that he admits he was late but feels the $400 fine is excessive and would like the fine to be reduced by 50%.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
