RE:
Request that the Board waive the $600 campaign finance late fee assessed against Jerrelda Drummer-Sanders, a candidate for Council Member, District E, Orleans Parish, in the November 6, 2012 election, whose 10-G campaign finance disclosure report was filed 14 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Jerrelda Drummer Sanders states that she would like to contest the fee because she feels that it was issued in error.

She states she filed all her documents in a timely manner. She had received communication concerning the filing of last report and she contacted our office immediately. Once she contacted our office she spoke with Gene Dawson in the IT department and it was determined that she had in fact misfiled her 10-G report. She states that it took a couple of days to look over the document and correct errors, but says she was in compliance and communication with the office at all times. She further states that she has been looking through her files for a communication that she received from our office indicating that there was a problem stating that she had a certain amount of time to respond.

However she is unable to locate the documents and she has discarded most of the information associated with the campaign after shutting down her headquarters. She said she also wanted to add that the communication was also sent to her home address as this certified letter was delivered to the same address.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
