Advisory opinion regarding whether the Director of the Worker's Compensation has the authority to make a final decision on conflicts of interest involving the medical director or associate medical director and the parties to a dispute and what situations would cause a conflict of interest to arise between the medical director or associate director.
Facts:
In the 2013 Regular Session of the Louisiana Legislature, Act No. 317 was passed which created the positions of medical director and associate medical director, who are full -time public employees of the Office of Workers' Compensation administration assigned with the sole task of deciding disputes regarding medical necessity. Act 317 also gives the Director of the Office of Workers' Compensation the authority to make a determination as to whether a conflict of interest exists between the medical director or associate medical director and the parties in deciding a medical necessity dispute. The statute further requires that the determination be made within two (2) business days.
Recommendations:
Adopt the advisory opinion.
