Advisory opinion regarding the post-employment restrictions on former DOTD employee Matthew Hebert who is currently employed with Huval and Associates, Inc.
Facts:
Former DOTD employee Matthew Hebert has requested an advisory opinion regarding post-employment restrictions to him as he has recently terminated his service with the Department of Transportation and Development(DOTD). He resigned July of 2013 as an Engineer 3 in the structural design gang 003 of the Bridge Design Section, under the Project Development Division of the Office of Engineering. He has stated that he was not an agency head and that he had no supervisory authority within Gang 003. He terminated his service so that he would be able to work closer to home. He has accepted a job with Huval and Associates, Inc. He has stated that while the job duties are similar to those which he had preformed for DOTD he would not be working on any project he had worked on in his employment with DOTD. All the projects he would work on with Huval that involve DOTD would be new projects.
Law:
1121 B. (1) General rule for other public employees. No former public employee shall, for a period of two years following termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the proposed advisory opinion.
