Advisory opinion regarding whether the Orleans Parish School Board (OPSB) will violate the Ethics Code if it approves a charter school application of a non-profit corporation which is partnered with Southern University at New Orleans (SUNO) at a time when OPSB member, Ira Thomas, is employed by SUNO.
Facts:
Edward M.Morris the General Counsel for Orleans Parish School Board has requested an advisory opinion regarding whether the OPSB will be in violation of any provision of the Code if it considers the charter school application of a nonprofit corporation which is partnered with SUNO at a time when one of the OPSB members Mr. Ira H. Tomas is employed as the Chief of SUNO Campus Police. the OPSB received a letter of intent to apply for a charter school from TMCF Collegiate Academy Inc a nonprofit corporation (TMCF). TMCF intends to partner with SUNO. According to documents provided by TMCF there is currently no financial relationship between TMCF and SUNO. However if granted a charter by the OPSB TMCF expects the TMCF/SUNO partnership to rent space from SUNO for a fee.
Recommendations:
Adopt the proposed advisory opinion.
