Advisory opinion regarding whether Benjamin Spann may accept employment with a company within two years of the termination of his employment with the Louisiana Department of Treasury when his new employer has a contract with the Louisiana Department of Treasury.
Facts:
Benjamin Spann was the former Director of the Unclaimed Property Division for the Louisiana Department of the Treasury. Mr. Spann retired effective June 23, 2012. My Spann has been recently hired, but has not began his first day of work, with a company that has a contract with the Department of Treasury to provide unclaimed property auditing services. A stipulation of his employment is that Mr. Spann will not have any contact, either directly or indirectly, with his former agency for a period of two years. The company has another employee who is responsible for all matters concerning the Louisiana Department of Treasury.

Law:
La. R.S. 42:1121A(1) prohibits a former agency head, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving his former agency or rendering any service on a contractual basis to or for such agency.

Recommendations:
Adopt proposed advisory opinion.
