RE:
Waiver request submitted by John Ray Crispino regarding a $1,300 late fee assessed for filing his R.S. 42:1114 financial disclosure 13 days late.
Facts:
In January 2013, Steven Crispino was appointed to the Terrebonne Port Commission. That same month an advisory opinion was requested regarding his service on that Commission while his father, John Ray Crispino, was employed with a vendor of the Commission. An advisory opinion was issued advising that no issue was presented by such employment; however, his father would be required to to file a R.S. 42:1114 financial disclosure statement.

The forms were forwarded to Mr. Crispino by his attorney and completed. The forms were forwarded to his son, Steven, since he knew his son also was required to file forms with the Board. However, Steven's form was not due until May 15th when John Crispino's form was due by May 1st. All forms were filed on May 14, 2013, timely for Steven, but untimely for his father.

This is Mr. Crispino's first late filing. The Board has not adopted any waiver guidelines for these type of disclosures.

Law:
La. R.S. 42:1114 provides that each public servant and each member of his immediate family who derives anything of economic value, directly, through any transaction involving the agency of such public servant or who derives any thing of economic value of which he may be reasonably expected to know through a person which (1) is regulated by the agency of such public servant, or (2) has bid on or entered into or is in any way financially interested in any contract, subcontract, or any transaction under the supervision or jurisdiction of the agency of such public servant shall disclose certain information as set forth in Section 1114.

Recommendations:
Waive the late fee.
