Waiver request submitted by Oakland Adams, Jr., a former member of the New Orleans City Park Improvement Association, regarding a $1,500 late fee assessed for filing his 2010 Tier 2.1 annual pfd 293 days late.
Facts:
Mr. Oakland acknowledges that he was late in filing his report. However, he was laid off in early 2010. He thought he was prepared to handle such; however, he was not prepared when he had to assume full-time care of his 89 year old mother, including feeding, bathing, administering medication, and caring for her. Mr. Oakland to remodel his home in order to accommodate his mother, including making it handicap accessible, installing a stair lift, new furniture, installing safety features in the bathroom. It also took almost a year to properly direct his mother's social security payments and pension payments to an account for her benefit. He was also responsible for scheduling doctor's appointments, renewing prescriptions, dealing with physical therapy for his mother. By Fall of 2012, Mr. Oakland was emotionally and physically drained. Mr. Oakland's life revolved around his mother and everything else in his life suffered. Mr Oakland has submitted financial information supporting that the assessment of the late fee would pose a financial hardship.

Mr. Oakland is no longer a member of the board.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Waive the late fee.
