Reconsideration of a waiver request submitted by Tina Pohlmeyer, a former member of the Workforce Investment Board, regarding a $600 late fee assessed for filing her 2010 Tier 2.1 annual pfd 12 days late.
Facts:
Tina Pohlmeyer is a member of the Workforce Investment Board. Ms. Pohlmeyer states that her employment was terminated and she moved to Texas to live with her family and try to find a job. Ms. Pohlmeyer assumed that when she was terminated, her service on the Workforce Investment Board terminated as well since it was her company who appointed her to the board. Ms. Pohlmeyer was unaware of the filing requirements. Further, she is still unemployed and the late fee assessment would cause her financial hardship.

The Board initially suspend all but $300 of the late fee. Ms. Pohlmeyer has submitted this request for reconsideration stating that she is a single mother, working to try to support two children and that she is barely making ends meet. She states that she cannot afford to pay the $300. She feels that we should be contacting her former employer because it was by virtue of that employment that she had to serve on this board. She thought that once her employment was terminated that she was not responsible for any other matters connected with that employment.

She has just started a new job and cannot take off work or afford for any money to be deducted from her pay check.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than fourteen (14) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Suspend all based on future compliance with the Code.
