Advisory opinion regarding whether the members of the Louisiana Rehabilitation Council are required to file annual pfds pursuant to La. R.S. 42:1124.2.1.
Facts:
The Louisiana Rehabilitation Council (LRC) is a federally mandated council by the Rehabilitation Act (34 CFR Part 361.16). The LRC consists of at least 51% of the members having a disability. The LRC has been given a budget of $27,000 to cover members' hotel expenses, meeting rooms, and members' travel mileages and meals. The LRC members do not have access to the budget other than receiving reimbursements. In accordance with 34 CFR Part 361.17(i), the LRC in conjunction with the Louisiana Rehabilitation Services, Office of Workforce Development, Louisiana Workforce Commission, develops a resource plan sufficient to carryout the functions of the LRC. Louisiana Rehabilitation Services Director has the authority to approve the budget. Once approved, the LRC Liaison approves and submits for payment all travel expenses, accommodation costs, and costs pertaining to the consumer satisfaction survey. The Louisiana Workforce Commission fiscal office reviews these expenses and processes the payments.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Adopt proposed advisory opinion.
