| Advisory opinion request regarding the post-employment restrictions on Thomas D. Davenport, Jr. a former member of the Rapides Parish Civil Service Board. |

Mr. Thomas D. Davenport has requested an advisory opinion regarding whether the post-employment restrictions found in Section 1121 of the Code of Governmental Ethics would prohibit him from representing Ms. Susan Wayne in front of the Rapides Parish Civil Service Board. Documentation has been submitted which shows that his appointment to the Rapides Parish Civil Service Board expired on October 14, 2011. Mr. Davenport has stated that Ms. Wayne never appeared in front of the Civil Service Board while he was a member.
Mr. Davenport is a practicing attorney in Rapides Parish and would like to be compensated for representing a Ms. Wayne in front of the Rapides Parish Civil Service Board. He supplied documentation signed by himself and Ms. Wayne to show that he has not received any compensation from Ms. Wayne in regard to any legal action which may be filed with the Rapides Parish Civil Service Board in which he participated as co-counsel on August 15, 2013. Mr. Davenport stated that when concerns were expressed that he was in violation of Section 1121 of the Code he immediately sought this opinion.

La. R.S. 42:1121 A (1) No former Agency Head or elected official shall, for a period of two years following the termination of his public service as the head or such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.
