Advisory opinion request regarding whether the Lake Charles Police Officers Association may lease a shooting range to the City of Lake Charles.
Facts:
The City of Lake Charles has traditionally contracted with other governmental entities for use of a shooting range for its officers. However, the police department's training division is now experiencing difficulty coordinating schedules with the other entities. The Lake Charles Police Officers Association would like to build a shooting range and lease the exclusive use of it to the City of Lake Charles for the training required in its police department. The Lake Charles Police Officers Association is a non-profit association and the money obtained from the City of Lake Charles would be used for operations and equipment purchases for the new range.
Law:
La. R.S. 42:1112A prohibits a public servant from participating in a transaction in which he has a personal substantial economic interest of which he may be reasonably expected to know involving the governmental entity.
a. R.S. 42:1113A(1)(a) of the Code prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
