Advisory opinion regarding whether Caddo Parish can rehire the former Parish Attorney, Charles Grubb, on a part-time basis.
Facts:
Charles Grubb retired as the Parish Attorney for Caddo Parish on September 1, 2013. There are several matters in which Mr. Grubb was engaged on behalf of Caddo Parish that may not be concluded by his retirement date. Caddo Parish is aware that Mr. Grubb is prohibited from contracting back with his agency for a period of two years from the date of his termination of service. However, Caddo Parish would like to re-hire Mr. Grubb as a part-time employee.

Law:
La. R.S. 42:1121B prohibits a public servant, for a period of two years following the termination of his public employment, from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
La. R.S. 42:1121B prohibits a former public servant, for two years, from assisting another person, for compensation, in a transaction in which she participated during her public employment and which involves the governmental entity.

Recommendations:
Adopt proposed advisory opinion.
