Advisory opinion regarding whether Bayou Land Trophies, owned by the wife of Bobby Badeaux, may continue to sell awards, trophies, plaques, and other recognitions to schools in Lafayette Parish while Bobby Badeaux serves as the Athletic Director of the Lafayette Parish School Board. |

Bobby Badeaux was promoted to Director of Athletics, Health, and Physical Education for the Lafayette Parish School Board effective August 1, 2013. Mr. Badeaux's duties include scheduling all middle school athletic events, in-service scheduling for coaches, and some oversight of physical education programs.
Mr. Badeaux's wife, Catherine Badeaux, owns and operates Bayou Land Trophies, which is not an incorporated company. The business sells awards, trophies, plaques, and other recognitions to schools, coaches and the public.
Ms. Badeaux does not have any contracts with the school board or any individual school in Lafayette Parish.
According to the school board, to make a purchase a school completes a Request for Withdrawal with an amount not to exceed requesting funds to be spent and purpose. The principal of the school would give prior written approval before the items are ordered or committed to. Mr. Badeaux does not have any oversight, control, or involvement in the purchase or payment process. The funds for these purchases come from fundraisers, gate fees or other fees. The funds are not budgeted in school activity accounts. The request for withdrawal is completed by the Account Sponsor, then submitted to the principal, who has the authority to approve or deny the request.

La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
