Untimely waiver request submitted by Charles Labbe, a member of the Human Service District, regarding a $150 late fee assessed for filing his 2011 Tier 2.1 annual pfd 3 days late.
Facts:
The waiver request was due on June 25, 2013. The waiver request was not submitted until July 26, 2013. Mr. Labbe's attorney who was responsible for filing the waiver request states that he drafted the waiver request dated June 25, 2013 and thought he had faxed the request timely. Mr. Andrus supplied the fax number it would have come from; however, the IT Department could not find any fax from the fax number on June 25, 2013 or around that date. Mr. Andrus states that it must have been an oversight as he has been traveling back and forth between his home and Houston to bring his mother to treatments at MD Anderson. He states that it was his responsibility and that he does not want Mr. Labbe to be penalized.

In regards to the waiver request, Mr. Labbe served without compensation and without reimbursement for any expenses.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Consider waiver request. Decline to waive.
