Waiver request submitted by Nettie Burchfield, Controller for Southeastern Louisiana University, regarding a $2,000 late fee assessed for filing her 2012 R.S. 42:1114 disclosure statement 20 days late.
Facts:
Nettie Burchfield is employed with Southeastern Louisiana University. Ms. Burchfield received income from a person that has a contractual relationship with her governmental entity. As such, she is required to file a disclosure annual with the Board disclosing the income received.

Ms. Burchfield has been timely on all other reports dating back to 2008. Ms. Burchfield states that May is a busy time of the year for her at school and, in addition, she has been dealing with a son with health issues that led to him having his colon removed on June 7, 2013.

There are no waiver guidelines for these types of disclosures. This is Ms. Burchfield's first late filing.

Law:
La. R.S. 42:1114 provides that each public servant and each member of his immediate family who derives anything of economic value, directly, through any transaction involving the agency of such public servant or who derives any thing of economic value of which he may be reasonably expected to know through a person which (1) is regulated by the agency of such public servant, or (2) has bid on or entered into or is in any way financially interested in any contract, subcontract, or any transaction under the supervision or jurisdiction of the agency of such public servant shall disclose certain information as set forth in Section 1114.

Recommendations:
Waive the late fee.
