Waiver request submitted by Tabitha Singleton, former member of the Workforce Investment Board, regarding a $1,250 late fee assessed for filing her 2011 Tier 2.1 annual pfd 25 days late.
Facts:
Ms. Singleton states that when she was appointed to Workforce Investment Board, that she was told that she would only have to come to a meeting every now and then and basically just needed her name on paper as a member of the board. Ms. Singleton only attended one meeting. Shortly after that, Ms. Singleton was promoted within her company and due to her travel schedule could not participate on the board and submitted her resignation. At no time, was she told of the filing requirements in connection with pfds.

In December 2012, Ms. Singleton was divorced and legally changed her name from Chamberlin to Singleton. She also moved in the Summer of 2012. The notice of delinquency went to a P.O. Box of her ex-husband and her ex-mother-in-law signed for the mail. While picking up her kids from Ms. Chamberlin, she is handed the certified letter, which is already past due. Ms. Singleton talked to someone on staff and obtain the information required to file her report.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Waive the late fee.
