PFD Answer submitted by Rebecca Howell, a former member of the St. Tammany Parish Council, regarding a notice of delinquency received requesting she file her 2011 Tier 2 annual pfd.
Facts:
Rebecca Howell was a member of the St. Tammany Parish Council. In 2011, Ms. Howell ran for re-election in the October 22, 2011 election. Ms. Howell was not re-elected. According to the Secretary of State, her term of office ended on January 9, 2012. Since Ms. Howell served for a brief period of time in 2012, her final report due the year following the termination of her office would be the 2012 Tier 2 annual pfd due by May 15, 2013.

Ms. Howell does not believe she should have to file the report for the 9 days she served in 2012. She states that her husband has a serious heart problem and getting the notice of delinquency upset him as well as her. She states that he is disabled and they cannot keep going through this. She states that she has already paid $400 for a campaign finance late filing. She states that she paid this fine in protest. She states that she and her husband are financially strapped and this will cause them more hardship.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Advise she is required to file the 2012 Tier 2 annual pfd within 7 business days from receipt of the notice of delinquency.
