RE:
Request the Board waive the $2,000 campaign finance late fee assessed against LA Restaurant Association Hospitality PAC, in the April 6, 2013 election, whose 10-G campaign finance disclosure report was filed 26 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Alan Yacoubian states that PAC committee is comprised of a group of individuals who serve on the committee on a volunteer basis. Due to the volunteer nature of such an undertaking, it has been difficult in the past to ensure a timely and complete filing of such campaign finance disclosure reports.

Accordingly, PAC recently amended its bylaws to provide that members of the Louisiana Restaurant Association, Inc. staff may assist in the preparation and filing of such reports to the Louisiana Ethics Board. He believes that such a corrective measure will ensure that all future reports are timely and properly submitted. Furthermore, they are now filing reports every thirty (30) days in accordance with LSA R.S. 18:1491.6I(1) in order to ensure that they remain on a regularly scheduled reporting system.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
