Advisory opinion request regarding whether an elected Councilman for St. John the Baptist Parish may be employed by the Port of South Louisiana.
Facts:
The Port of South Louisiana is considering hiring an elected Councilman for St. John the Baptist Parish as a Marketing Representative 1. St. John the Baptist Parish and the Port of South Louisiana are separate entities, but the Port of South Louisiana is located within the Parish and in some instances may come before the Parish Council for approval on various issues such as zoning. Ms. Folse, Executive Council for the Port of South Louisiana, refused to provide the name of the elected Councilman at issue.
Law:
La. R.S. 42:1111C(2)(d) prohibits a public employee from receiving compensation for or in consideration of services rendered to or for any person who conducts operations or activities which are regulated by the public employee's agency.

La. R.S. 42:1102(16) defines "person" to mean an individual or legal entity other than a governmental entity, or agency thereof.

Recommendations:
Decline to render an advisory opinion.
