Waiver request submitted by Irvin F. "Jiff" Hingle, former Plaquemines Parish Sheriff, regarding a $2200 late fee assessed for filing his 2011 Tier 2 annual pfd 22 days late.
Facts:
Attorney Brigid E. Collins submitted a waiver request on behalf of Mr. Hingle. Mr. Collins says Mr. Hingle did not timely file the report because he was under a federal investigation and it would have been imprudent for Mr. Hingle to make any of the disclosures that was requested. Supporting documentation of his incarceration has been provided. Mr. Hingle has been ordered to prison for 46 months and ordered to pay a $10,000 penalty.

As a response to his initial Notice of Delinquency received on October 29, 2012, Mr. Hingle filed an answer that he had not filed his taxes yet on November 12, 2012. He did not request an extension to file his 2011 pfd before the May 15th deadline. At its February 2013 meeting, the Board concluded Mr. Hingle was required to file a 2011 PFD within seven days from receipt of the NOD. He received the board result letter and Notice of Delinquency on May 9, 2013 and the due date for filing was May 16, 2013. He filed the report on June 7, 2013, 22 days late.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
