Waiver request submitted by Charles R. Adams, II, a member of the Terrebonne Economic Development Authority, regarding a $1500 late fee assessed for filing his 2010 Tier 2.1 annualf pfd 315 days late.
Facts:
Mr. Adams states he served on the board from 2007 to his resignation in 2011 voluntarily and uncompensated. In February 2011, his wife was diagnosed with cancer and he was responsible for caring for his wife and three young children. Because of these circumstances, he resigned his position in March 2011. He submitted documentation to prove that he resigned at the March board meeting.

Mr. Adams says he originally filed his 2010 pfd with his 2011 pfd on June 18, 2012 via fax. A request was sent to the IT department to request faxes from that number to be pulled for review. A review of faxes sent from the same number as the 2011 pfd indicates that only one 4 page fax was sent on June 18, 2012. His 2011 pfd is 4 pages long; therefore, the 2010 pfd was not included with the original fax.

Mr. Adams has submitted documentation documenting his wife's cancer treatment in spring 2011.

La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Waive the late fee.
