Waiver request submitted by Stephen Thomas Broussard, a member of the Mermentau River Harbor and Terminal District, regarding a $1500 late fee assessed for filing his 2010 Tier 2.1 annual pfd 337 days late.
Facts:
Mr. Broussard indicates that he thought his accountant had filed the report. Mr. Broussard's accountant thought that Mr. Broussard filed the report. He also says he resigned from the Board. Mr. Broussard states that he lost his job and was unemployed for four months. He had to sell his house for less than he owed and take a loan out for the balance. He has two children in college and he feels it will take him a long time to get out of the financial hardship this all has created.

Mr. Broussard received a "second notice" which triggered the filing.

A request for supporting documentation of the financial hardship was sent to Mr. Broussard on September 16, 2013. The deadline for submitting the information was October 16, 2013. On October 9, 2013 he submitted the information. Mr. Broussard submitted documentation of his monthly budget and his debt accounts. He has also submitted copies of credit card bills, college tuition bills, utilities bills, insurance bills, and his 2012 tax returns.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance.
