RE:
Request the Board waive the $60 and $600 campaign finance late fees assessed against Earnestine Anderson-Trahan, a candidate for Judge, 2nd City Court, Orleans Parish in the November 6, 2012 election, whose 10-G and EDE-G campaign finance disclosure reports were filed 1 and 192 days late.
Facts:
In connection with his request that the Board waive the late fees assessed for the late filing of the reports, Krystal Ancar report preparer for Earnestine Anderson-Trahan states that the reason she did not file the EDE-G report was due to a miscommunication between her and an Ethics employee. She stated that on several occasions she was contacted by "Amanda" to discuss the reports and reporting for the finance reports. During the run off election December 8, 2012, the candidate had all volunteer workers and no transactions that required reporting. When discussing the possibility of having all volunteer, she said she understood that to mean that no report was needed since the report would not have any endorsements, advertisements and/or contributions for the December 8, 2012 election Day. She said that once Cheryl from the Board of Ethics contacted her in regards to the report not being filed, the report was completed with no transactions and submitted.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
