RE:
Request that the Board waive the $240 and $400 campaign finance late fees assessed against Waylon McCormick, a candidate for Justice of the Peace, Ouachita Parish in the October 19, 2013 election, whose 10-P and EDE-P campaign finance disclosure reports were filed 6 and 10 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Waylon McCormick states that this is his first attempt at running for a publicly elected position and he is learning. Reading the rules and regulations, he thought the he did not have to report at all if he spent less than $2500 and also understood the rule to say if funds come from immediate family members that he did not have to report those. He did call the Board of Ethics office to verify the rules and learned that funds donated by his brother ($750.00) would have to be reported so he quickly prepared the financial statement as instructed. As he was preparing the report he received another donation of $100 and had to re-do the report. He states that this was the first report during the election process and he had already sent in the final report way before time. Also states that he did not realize that he was required to file an EDE-P report, he said he filed the EDE-P report as soon as he received notification and says that he did not receive or spend anything on the day of the election.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
