Request that the Board waive the $400, $1,000 and $1,000 campaign finance late fees assessed against Richard "Dale" Wolfe, a candidate for Councilman at Large, Division A, St. John the Baptist Parish in the October 22, 2011 election, whose 10-P, EDE-G and 40-G campaign finance disclosure reports were filed 574, 526 and 496 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Richard "Dale" Wolfe, Sr., states that he apologizes for his irresponsibility and not attending to this very important paperwork. He states that severe health problems and attempts to resolve numerous personal and family problems have preoccupied his mind and left him very disadvantaged on these issues. He states that his political life ended in the 2011 election. He says he is 73 years old and suffers with an extreme migraine condition that places him in bed and incapacitated for weeks at a time.

His employer St. John the Baptist Parish School Board has been very patient with him because he says he needs the income to survive and pay basic bills at his home. Social Security covers his house note and the repairs from a fire that badly damaged his home approximately 2 years ago. He states that he has no funds in his campaign account as he had to borrow money to cover the cost of that election of which he took some of the equity in his house for the bank loan. He states that he can only place himself at the mercy of the esteemed honorable Board.

He says he appreciates that this Board has a responsibility and has to exert its powers to maintain order in the political system. He hopes the members can understand his unfortunate predicament and grant his waiver. He says he simply does not have the funds or means to pay this fee and that he will make every effort to resolve his past due accounting of his campaign funds.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
