| Advisory opinion request regarding whether Jimmy Anthony, Assistant Secretary of Wildlife for the Department of Wildlife and Fisheries, may serve as a board member for Hunters for the Hungry. |

Pursuant to La. R.S. 36:608 and 609(B) Mr. Anthony is responsible for performing the functions related to the administration and operation of all programs within the Wildlife Division of the Department of Wildlife and Fisheries. Hunters for the Hungry is a non-profit organization that coordinates the donation of game meat from hunters to food banks across Louisiana. During the 2013 Regular Session of the Louisiana Legislature, Act 366 was passed allowing purchasers of hunting and fishing licenses to include a donation to Hunters for the Hungry. These donations are placed in a special fund with the Conservation Fund and distributed to Hunters for the Hungry. As Assistant Secretary, Mr. Anthony exercises no authority over the licensing system, donations, or the Conservation Fund. Mr. Anthony would receive no compensation for serving as a board member for Hunters for the Hungry.

Section 1123(1) allows a public servant to participate in the affairs of charitable, religious, nonprofit educational, public service, or civic organizations, bona fide organizaed volunteer fire departments when no compensation is received.
