Untimely waiver request submitted by Joyce Smith Glapion, a member of the Finance Authority, regarding a $1500 late fee assessed for filing her 2010 Tier 2.1 pfd 442 days late.
Facts:
The deadline for requesting a waiver or paying the $1500 late fee was September 9, 2013. Neither was received. Ms. Glapion filed a waiver on September 19, 2013. It was 10 days late. On September 18, 2013 she faxed only a cover page. Staff retrieved the phone number and called Ms. Glapion. She then mailed the waiver request the next day. Ms. Glapion states she moved to Chicago with her daughter in September 2009 because of hurricane Katrina. She states that she flew back and forth to attend meetings and deal with recovery, which became overwhelming. It should be noted that on the report filed in 2013, she lists her address in New Orleans, which is where all notices have been sent.

Ms. Glapion states she recalls calling an executive meeting to resign, but does not remember the date and did not submit anything in writing. It does not appear that she is currently a member of the board.

Ms. Glapion says the imposition of the late fee would cause a financial hardship since she lives on a social security check and retirement.

On October 25, 2013, a request for supporting documentation was sent to Ms. Glapion. The deadline for submitting the information was November 25, 2013. We have not received any information.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Decline to waive.
