Advisory opinion regarding whether members of the Ascension Parish Industrial Development Board may participate in matters before the Board involving their employers.
Facts:
Ascension Parish created the Ascension Parish Industrial Development Board pursuant to La. R.S. 51:1151. Part of the Board's duty is to acquire property and lease property to industrial commercial entities. The property which is leased is exempt from ad valorem taxes. The members of the Board are appointed by the Ascension Parish Council. Various governmental entities submit names of employees to seek appointment to the Board. The Parish President seeks an opinion as to whether the potential appointees may vote on matters that impact the receipt of ad valorem property taxes by their governmental employers.

Law:
Rule 601 states that the Board shall receive requests for advisory opinions filed with it by affected persons.

Rule 101 defines affected person as any person or governmental agency, or authorized representative of such person or agency with a demonstrable and objective interest in the board's interpretation, construction, and application of any law within the board's jurisdiction.

Recommendations:
Decline to render for lack of standing.
