Advisory opinion regarding whether Lambert Hassinger may participate as a member of the Southeast Louisiana Flood Protection Authority-East in matters involving the lawsuit filed by the Southeast Louisiana Flood Protection Authority-East against 97 oil and gas companies, if his law firm, Galloway, Johnson, Tompkins, Burr, and Smith, provide legal services to any of the oil companies which are defendants in the lawsuit filed by the Southeast Louisiana Flood Protection Authority-East.
Facts:
Lambert Hassinger, Jr. is a member of the Southeast Louisiana Flood Protection Authority-East Board of Directors. The Southeast Louisiana Flood Protection Authority-East Board filed a lawsuit against 97 oil and gas companies seeking recovery for damages to the Louisiana coast.

Mr. Hassinger is also a Director in the law firm of Galloway, Johnson, Tompkins, Burr, and Smith. Mr. Hassinger does not own or control an interest of 25% or more in the Galloway Johnson law firm. Mr. Hassinger is one of 22 directors who owns an equity interest in the law firm.

Neither Mr. Hassinger nor his firm is counsel of record in the litigation filed by the Southeast Louisiana Flood Protection Authority-East Board. His law firm does not represent any defendant in the litigation.

Mr. Hassinger seeks guidance on whether he can participate in matters involving the lawsuit that may come before the Southeast Louisiana Flood Protection Authority-East Board if his firm represents one of the oil and gas companies named as a defendant, but only in matters that are totally unrelated to the litigation, and in areas of practice that has nothing to do with damage to the coast, coastal restoration or any issue related to that.

Law:
La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he is an officer, director, trustee, partner, or employee has a substantial economic interest.

Recommendations:
Adopt proposed advisory opinion.
