RE:
Advisory opinion regarding whether Jefferson Parish Council may direct the Jefferson Parish Attorney's office to take on additional duties that were previously assigned to the Ethics and Compliance Director.
Facts:
Mark Spears, member of the Jefferson Parish Council states that the Council would like to assign the following duties to the Jefferson Parish Attorney's office:

(1) Developing, initiating, maintaining, and revising policies and procedures for the general operation of the compliance and ethics program and its related activities to prevent illegal, unethical, or improper conduct;

(2) Developing and periodically reviewing and updating standards of conduct to ensure continuing currency and relevance in providing guidance to parish officials and employees;

(3) Collaborating with the other parish departments to direct compliance issues to appropriate existing channels for investigation and resolution;

(4) Responding to alleged violations of statutes, ordinances, rules, regulations, policies, procedures, and standards of conduct by evaluating or recommending the initiation of investigative procedures;

(5) Developing and overseeing a system for uniform handling of such violations and to serve as an independent review and evaluation authority to ensure that compliance issues and concerns within the parish governmental organization are being appropriately evaluated, investigated and resolved;

(6) Providing reports on a regular basis, and as directed or requested, to keep the compliance committee, the parish president and the council informed of the operation and progress of compliance efforts;

(7) Reporting of violations or potential violations to duly authorized enforcement agencies appropriate and /or required;

(8) Collaborating with the department of human resource management and others as appropriate to develop an effective compliance training program, including appropriate introductory training for new employees as well as ongoing training for all employees and managers;

(9) Monitoring the performance of the compliance and ethics program and related activities on a continuing basis, taking appropriate steps to improve its effectiveness;

(10) Collaborating with the internal auditor to include internal controls to insure compliance with established parish policies and compliance with parish, state, and federal laws;

(11)Advising the governmental and ethics compliance and audit committee with objective assessments on the state of the parish's compliance and ethics issues.

Recommendations:
Adopt the proposed advisory opinion.
