Advisory opinion regarding whether part-time, on-call, and temporary employees for Jefferson Parish are required to receive mandatory one hour ethics training.
Facts:
Jefferson Parish employs approximately 800-900 part-time, on -call, temporary Recreation Department workers. The majority are summer workers who work much less than 90 days, in fact some of these employees may only work once month or less. For purposes of Parish record keeping and payroll, the workers' status is active to ensure they are available when called upon to work and can easily receive compensation for their services.
Law:
1170A(3)(a)(i) Commencing on January 1, 2012, each public servant who was not required to complete education and training pursuant to Paragraph (1) or (2) of this Subsection shall receive a minimum of one hour of education and training on the Code of Governmental Ethics during each year of his public employment or term of office, as the case may be.

1170A(5) A former public servant whose public service in a calendar year lasted less than ninety days shall not be required to receive education and training on the Code of Governmental Ethics.

Under 42:1102(19) "Public servant" means a public employee or an elected official. (18)(a) "Public employee" means anyone, whether compensated or not, who is: (iii) Engaged in the performance of a governmental function. (iv) Under the supervision or authority of an elected official or another employee of the governmental entity.


Recommendations:
Adopt the proposed advisory opinion.
